Scope of Representation and Fees
When we accept a criminal case, we assume full legal responsibility for that matter. Once we enter a formal appearance, we cannot always control whether a judge will allow us to withdraw. Therefore, our retainer is designed to cover all aspects of your case up until it is time to set the matter for trial.
Felony Cases
For a felony, the retainer covers all court appearances through the preliminary hearing. Our goal is to secure the best possible offer before that hearing, as prosecutors rarely improve their offer once they have expended the resources to prepare for testimony. If necessary, our representation includes filing motions to suppress evidence during this phase.
Should a judge find sufficient evidence to move the case forward, the arraignment follows twenty days later. At that stage, you may choose to pay the trial fee, allowing us to set a trial date and proceed. If you choose not to proceed to trial with our firm, we will request to withdraw so that you may seek representation through the Public Defender’s Office.
Misdemeanor Cases
For misdemeanors, our retainer covers exhausting all legal avenues and presenting you with the best possible resolution. If you choose to reject an offer and proceed to trial, you may either pay the trial fee or allow us to withdraw so you can proceed with the public defender.

Going to trial is a significant undertaking that requires an immense amount of preparation and effort. Because of this, trial fees are determined by the complexity of the specific case. We may not always be able to set a "trial cap" at the moment we are retained; in many instances, we must first review the evidence to provide a realistic estimate of the work required.
We are committed to total transparency regarding these costs. If, after reviewing the case, you decide you do not wish to pay the trial fee, you are under no obligation to do so. However, the initial retainer covers all professional services and legal work performed up to the point that the decision is made.
